POP-UP APPLICATION INFORMATION + TERMS

DOING / LIVING is an inclusive marketplace supporting makers, artists, and practitioners with a focus on sustainable and conscious materials and intentions. The applications will be reviewed according to our juried outline of sustainable and conscious brands, artists as well as artistry, booth set up, and product category.

Booth fee covers open space within booth size and advertising. Limited tables and chairs are available to rent through DOING LIVING. Vendors are required to bring their own display items and furniture.

Participants and sellers are required to have tax and permit requirements associated with conducting sales of merchandise, services, food/bev, etc. Please refer to the IRS and state/city tax requirements.

After your application is reviewed and if accepted we will send an invoice for payment. Any vendor that does submit within 3 days of receiving invoice will forfeit their spot. When payment has been received we will send you information about move in/out, marketing materials, and any other information pertaining to the pop up! 

Cancellation policy:

No refunds will be offered starting two weeks prior to the date of pop up.

By submitting and signing this application, if approved, you are entering into an agreement (the “Agreement”) dated July 10, 2017 with Doing Living Group LLC d/b/a Doing Living Marketplace, a New York limited liability company (“Doing Living”). The signatory (the “Participant”) is choosing to participate in the August Eclipse Pop-up(s) on the date(s) selected above (the “Event”). This Agreement is effective for the Event in which the Participant agrees to participate. This Agreement may be terminated by Doing Living with or without cause immediately upon notice to Participant and Doing Living will promptly return any Participation Fees collected from the Participant. Participant and its employees, personnel, and agents agree to be bound by the terms of this Agreement and all Event rules and regulations. After the Participant’s application is reviewed and if accepted, Doing Living will send an invoice for payment. Any Participant who fails to submit payment within 3 days of the invoice date, will forfeit his/her spot. After payment has been received, Doing Living will send the Participant move-in/move-out information, marketing materials, as well as any other pertinent information. Doing Living will not offer refund for any cancellations less than 2 weeks before the Event takes place due to the administrative work and upfront cost already incurred by that time. Once Participant cancels, he/she will be forced to forfeit their spot in the Event. Irrespective of the place of execution or performance, this Agreement shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any of its conflicts of law principles. Any dispute under this Agreement shall be litigated only in a court of competent jurisdiction in the State and County of New York. If any provision of this Agreement or the application thereof to any person or circumstance shall, for any reason and to any extent, be invalid or unenforceable, the remainder of this Agreement and the application of that provision to other persons or circumstances shall not be affected. Participant is expected to act with the highest regard for the safety of the attendees and other participants of the Event, and will adhere to all laws, policies, rules, and regulations applicable to the goods and/or activities of Participant, including obtaining all licenses, permits, and approvals that may be required to enable Participant to conduct its activities at the Event and fulfill its obligations under this Agreement. Participant expressly assumes all risks of loss, damage, liability, injury, or destruction resulting from any cause whatsoever, including but not limited to acts or omissions by Participant, and hereby releases and waives any claims against Doing Living related to such loss, damage, liability, injury, and/or destruction. Participant represents that he/she has, or will have at the time of the Event, appropriate insurance to cover liability for the types of activities Participant will conduct at the Event. Participant is fully responsible for any of its liabilities, actions, or omissions, and will indemnify, defend, and hold Doing Living harmless against any claims related to Participant’s liabilities, actions, or omissions. This Agreement can not be assigned to any third party, or delegate any of its obligations without the written consent of Doing Living. Only approved Participants are able to conduct business/activities at the Event. The vendor list and booth/space assignments are subject to change without notice. Doing Living does not guarantee any level of attendance at the Event and there will be no refunds, under any circumstances, after the Event ends. The terms of this Agreement may be changed by Doing Living and notice of such change(s) will be sent to Participant in writing. Participant agrees to accept notices via email, sent to the address indicated below. Doing Living reserves the right to decline, prohibit, any activity, displays, product, or conduct, which (in Doing Living’s sole discretion) is out of keeping with the character of the Event or is deemed inappropriate or dangerous. The relationship of Participant to Doing Living is that of an independent contractor, and nothing contained in this Agreement will be construed as creating a partnership, joint venture, employment relationship, agency, or other relationship between the parties, or to make Doing Living liable for the debts or obligations of Participant. Participant and its agents, employees, personnel, and/or independent contractors who participate in the Event agree to be bound to this Agreement. Participation fee covers open space within booth size and advertising. Vendors are required to bring their own display items and furniture. Participants are expected to have their booths set up at least half an hour before the opening time and Participants are expected to break down their booths within two hours of the closing time on the last day of the Event.
